Terms and Conditions

The terms and conditions defined below govern the services provided by The DIY Guys online store. They define what customers can and cannot do when using these services, as well as obligation that The DIY Guys have to you.

Note: These terms and conditions may be amended from time to time. These amendments will take effect from the time of posting and you should check back from time to time for any such amendments.

Registration

a. To purchase a product from The DIY Guys online store, you must first register with the store. Registration is free and does not obligate you to purchase anything.

b. To register, you must be over 18 years of age and not be an undischarged bankrupt or under any type of insolvency administration, where you are in a company.

c. You must provide correct information when registering and ensure that you keep this information current. The DIY Guys are not responsible for any loss or damage (including misdirected emails or deliveries) which may occur if you provide us with incorrect information.

d. When you register with The DIY Guys online store, you must choose a password. You are responsible for the security of this password. The DIY Guys assume that anyone using password is authorised by you. Unauthorised access and use of your details does not reduce your liability in connection with using the DIY Guys online store. This includes your obligation to purchase a product which may result from use of your password. You must notify us immediately if you become aware of any unauthorised use of your password or of any other security breach.

e. The DIY Guys may email you the following information:

  • Confirmation of your order
  • Your invoice
  • Status of your order
  • Newsletters and promotional offers. You may opt out of these emails at any time.

Sales and Payments

a. The customer is required to pay the purchase price, including GST, in full at checkout.

b. All transactions are processed in Australian dollars (AUD).

c. Credit card (Visa and Mastercard) and PayPal payments are accepted. Paypal payments are accepted through the PayPal online payment system. You do not require a PayPal account to make a direct credit card payment.

d. Sale items are only available during the period that they are advertised in The DIY Guys online store.

Pricing

a. All of our prices are in Australian dollars (AUD) and include GST (Goods and services tax) as of 21 July 2011. Product prices are regularly updated when price changes are received from our suppliers. If you find a cheaper advertised price somewhere else, email or phone us with the details of the supplier together with prices of the product required and we will endeavour to provide you with a more competitive price.

Warranties

a. All products sold by The DIY Guys are warranted as:

  • Merchantable quality
  • Fit for purpose for which goods of that type are ordinarily used
  • Matching the description of them on The DIY Guys online store (other than minor differences).

b. All products are covered by either a 12-month or 24-month warranty. The warranty period (12 or 24 months) is dependent on the product. Please refer to the product description page for warranty information specific to a product.

c. Your product will be repaired, replaced or refunded within 21 days, at the discretion of The DIY Guys, if it is found to be defective - exclusive of damage caused by improper or unreasonable use. Warranty does not apply to normal wear, including scratching or accidental breakage.

d. Product details, images and line drawings may vary depending on installation and specific product models. Information provided is only a representation of the products available.

e. The DIY Guys will not be liable for any loss or damage to furniture, floor coverings, walls, fixtures or any other consequential loss of any kind caused by any defect in the product or components.

f. The DIY Guys reserve the right to provide minor components, for example, handles, aerators, buttons, dress rings, hinges, clips, rod and washers, as parts only to the customer who is responsible for their installation. The DIY Guys will not be liable for any claims for labour, additional products or parts associated with a faulty product.

g. All tapware, including mixers, showers and diverters must be installed by a licensed plumber or installer.

h. The warranty period starts from the date of purchase.

i. The warranty shall be void for the following reasons:

  • Inability to provide proof of purchase and a copy of your plumber's installation invoice (paid).
  • Products are not installed by a licensed plumber or installer.
  • Products are not installed to relevant National Standards and State Regulations.
  • Exposure to water pressures greater than 500kPa.
  • Fitting of other devices to the outlet of tap ware. For example water filters.
  • Fitting of flow controllers in tap body.
  • Non-installation of flow regulated check valve in wall elbows for hand showers.
  • Products used for incorrect applications, non-potable water etc.
  • Damage as a result of obstructions due to inadequate flushing of system before use.
  • Damage to finishes by adhesives, sealants etc.
  • Failure to clean and replace outlet aerator inserts etc.
  • Damage to finishes which arise from installation or post installation use.

Return of Non-Defective Products

a. The DIY Guys understand that buying online can be filled with uncertainty. That's why The DIY Guys provide you with a "no-hassle" 14 day satisfaction guarantee. This means that you can return a product for any reason, within 14 days of the original purchase date. You are entitled to a full refund of the original purchase price (minus shipping charges) when you return new and unused items within 14 days of the date on your invoice.

b. The product must be returned in its original condition, that is, NOT damaged, opened or used.

c. Please allow 21 days for the payment of your refund.

d. A 20% restocking fee will be charged (not applicable for products that are not as described).

e. Postage charges are not refunded.

f. To return non-defective goods:

i. Email the details of the return to The DIY Guys. - The DIY Guys will email you a return form to complete.

ii. Complete the return form.

iii. Send the completed return form to The DIY Guys, along with the item you're returning and your proof of purchase:

g. The customer is responsible for return shipping charges. The DIY Guys cannot be held responsible for any items lost or damaged in shipping.

h. If The DIY Guys email you a return form and they do not receive a response or the returned product from you within 14 days, your right to return the item and receive a refund will be waived.

Return of Defective Products

a. Defective goods may be returned within the warranty period. The warranty period starts from the date of purchase.

b. Upon receiving a returned product, The DIY Guys will inspect and test the product to determine its condition and, if the product is found to be in good working order and your claim as to the faulty nature of the product if reasonably determined by us to be invalid, the product will be returned to you and you will be charged all delivery charges incurred by The DIY Guys in relation to the return and subsequent return of the product.

c. Your product will be repaired, replaced or refunded within 21 days, at the discretion of The DIY Guys, if it is found to be defective - exclusive of damage caused by improper or unreasonable use. Warranty does not apply to normal wear, including scratching or accidental breakage.

d. To return defective goods:

i. Email the details of the return to The DIY Guys.

ii. Complete the return form.

iii. Send the completed return form to The DIY Guys, along with the item you're returning, your proof of purchase, and a copy of your plumber's installation invoice (paid):

e. The customer is responsible for return shipping charges. The DIY Guys cannot be held responsible for any items lost or damaged in shipping.

Shipping, Insurance and Title

a. Free shipping if offered on sales within Australia only.

b. Insurance is included with all shipping.

c. All products must be delivered to a specified street address (no P.O. boxes) and receipt must be acknowledged by signature.

d. Title will pass to the customer when The DIY Guys receive the invoiced amount in cleared funds. If the title has passed, that will not affect the rights of The DIY Guys to terminate a sale.

e. The customer cannot change or request to change their delivery address details after a sale. The DIY Guys hold no responsibility if an order is not delivered in the event that a customer changed their delivery address details after the sale.

Gift Vouchers

a. DIY Guys gift vouchers must be redeemed in The DIY Guys online store (www.diyguys.com.au) and used towards the purchase of eligible products. Purchases are deducted from the gift voucher balance and any unused gift voucher balance may be used towards another purchase. If an order exceeds the amount of a DIY Guys gift voucher, the balance must be paid via credit card (Visa or Mastercard).

b. DIY Guys gift vouchers cannot be used to purchase other gift vouchers. Gift vouchers cannot be resold, transferred, redeemed for cash or applied to any other DIY Guys online store account. Unused DIY Guys gift voucher balances may not be transferred.

c. The DIY Guys are not responsible if a gift voucher is lost or destroyed or used without the recipient’s permission.

d. DIY Guys gift vouchers cannot be returned or refunded.

e. DIY Guys gift vouchers are valid for 12 months from the issue date.

f.  The standard terms and conditions of The DIY Guys online store apply to DIY Guys gift vouchers.

Privacy

a. The DIY Guys are committed to protecting the privacy and security of your personal information. To ensure customer satisfaction and continued patronage, The DIY Guys operate under a strict code of conduct for their online store, which is described in their Privacy Statement.

b. The DIY Guys do not sell personal information to other mailing lists.

c. By registering with The DIY Guys and accepting their terms and conditions, you also agree to:

  • Collection of personal information which is defined in the Privacy Statement. This information includes customer name, delivery and billing addresses, email address and phone details.
  • Use of personal information for purposes defined in the Privacy Statement. These purposes include internal use for improving our service, meeting our obligations under State or Federal law, and administrative purposes connected with The DIY Guys online store.
  • We may disclose your information in the circumstances defined in the Privacy Statement.
